By downloading, installing, or using the Medico mobile application and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Medico ("we," "us," or "our").
2. Description of Service
Medico is a personal health management platform that helps users:
- Track medications, dosages, and schedules with reminders.
- Store and manage health records including lab reports, health conditions, and care plans.
- Receive drug interaction alerts and side effect information.
- Record and transcribe healthcare provider conversations.
- Access AI-powered health insights based on their health profile.
- Manage caregiver access with granular permissions.
- Receive personalized health news and articles.
- Send SOS emergency alerts to designated contacts.
Medical Disclaimer
Medico is not a medical device and does not provide medical advice, diagnosis, or treatment. The Service is intended for informational and organizational purposes only. All health insights, drug interaction alerts, and AI-generated content are informational and should not be used as a substitute for professional medical judgment. Always consult your healthcare provider before making any changes to your medications or treatment plan.
3. Account Registration and Security
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the confidentiality of your account credentials.
- You must notify us immediately of any unauthorized use of your account.
- You must be at least 18 years of age to create an account. Caregiver accounts may be used to manage the health information of dependents.
- You may only maintain one account per individual.
4. User Responsibilities
You agree to:
- Provide accurate health information. Inaccurate data may lead to incorrect insights, interaction alerts, or recommendations.
- Verify all drug interaction alerts and health insights with your healthcare provider before acting on them.
- Use the SOS alert feature responsibly and only in genuine emergency situations.
- Obtain consent from healthcare providers before recording conversations using the app's recording feature, in compliance with applicable recording consent laws in your jurisdiction.
- Maintain appropriate caregiver permissions and promptly revoke access when no longer appropriate.
- Keep your app and device updated to ensure you have the latest security patches.
5. Caregiver Accounts
- Patients can invite caregivers and grant specific permissions controlling what health data caregivers can view and manage.
- Caregivers must only access and use patient information for the purpose of providing care.
- Patients can modify or revoke caregiver permissions at any time.
- Caregivers agree to maintain the confidentiality of all patient health information they access through the Service.
6. Health Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your health information. Key points:
- You retain ownership of all health data you enter into Medico.
- We do not sell your personal information or health data.
- Health data is stored locally on your device and synchronized to secure cloud servers.
- We implement security measures consistent with HIPAA requirements to protect your health information.
7. AI-Powered Features
Medico uses artificial intelligence to provide health insights, answer questions, and generate recommendations. You acknowledge that:
- AI-generated content may contain errors or inaccuracies and should be verified with healthcare professionals.
- AI features are not a replacement for medical consultation, clinical judgment, or professional healthcare advice.
- Health data may be processed by third-party AI services under strict confidentiality agreements to generate your insights.
- AI models and their outputs may change over time as we improve the Service.
8. Drug Interaction and Safety Alerts
- Medico provides drug interaction alerts based on publicly available pharmaceutical databases (RxNorm, FDA).
- These alerts may not be comprehensive. Not all interactions are known or documented in these databases.
- The absence of an alert does not mean no interaction exists.
- Always inform your healthcare provider and pharmacist of all medications and supplements you are taking.
9. Provider Recordings
- You are solely responsible for complying with all applicable laws regarding the recording of conversations, including obtaining required consent from all parties being recorded.
- Recording laws vary by jurisdiction. Some jurisdictions require all-party consent.
- Medico is not responsible for any legal consequences arising from your use of the recording feature.
- Transcriptions are generated by AI and may not be 100% accurate.
10. Intellectual Property
- The Medico app, its design, features, and content (excluding user-provided data) are owned by Medico and protected by intellectual property laws.
- You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes.
- You may not copy, modify, distribute, sell, or lease any part of the Service.
- You may not reverse engineer or attempt to extract the source code of the Service.
11. Prohibited Uses
You may not use the Service to:
- Enter false health information for any individual.
- Access another person's health data without proper authorization.
- Interfere with or disrupt the Service or its infrastructure.
- Use the Service for any illegal purpose.
- Attempt to gain unauthorized access to any part of the Service.
- Use automated scripts or bots to interact with the Service.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEDICO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES ARISING FROM:
- Reliance on any health insight, drug interaction alert, or AI-generated content provided by the Service.
- Inaccurate, incomplete, or delayed medication reminders or notifications.
- Errors in transcription of provider recordings.
- Unauthorized access to your account due to your failure to maintain account security.
- Service interruptions or data loss.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
13. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
14. Indemnification
You agree to indemnify, defend, and hold harmless Medico and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any third party's rights.
15. SMS Communications & Consent
By providing your mobile phone number and tapping Login or Create Account in the MedicoApp mobile application, you give express written consent to receive transactional text messages from MedicoApp at the number provided, including via automated technology. Consent is not a condition of any purchase.
Message types you may receive
- One-time passcodes (OTPs) for sign-in and account verification — e.g.: "MedicoApp: Your verification code is 123456. This code expires in 10 minutes. Do not share it. Msg&data rates may apply."
One-time passcodes are the only SMS messages MedicoApp sends. We do not send marketing or promotional SMS, and we do not send other transactional messages by SMS. Message frequency is limited to your sign-in activity. Message and data rates may apply.
Opting out and getting help
- Reply STOP to any message to immediately stop further SMS to that number. You may also opt out by deleting your account from within the app or by emailing support@medicoapp.ai.
- Reply HELP to any message to receive support contact information.
- For assistance, email support@medicoapp.ai.
Mobile carriers are not liable for delayed or undelivered messages. SMS data is handled in accordance with our Privacy Policy and is not shared with third parties for marketing purposes.
16. Termination
- You may stop using the Service and delete your account at any time.
- We may suspend or terminate your access if you violate these Terms or if required by law.
- Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy.
17. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes through the app or by email at least 30 days before they take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.
18. Governing Law and Disputes
These Terms are governed by the laws of the State of New York, United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in New York, NY, except that either party may seek injunctive relief in any court of competent jurisdiction.
